As a result of actions taken by Gildia Sp. z o. o. registered in Lublin, which SECO/WARWICK Europe Sp. z o. o. considers to be unlawful, SECO/WARWICK Europe Sp. z o. o. registered in Świebodzin has filed a protection of personal rights lawsuit in the Regional Court in Poznań against Gildia Sp. z o. o.
The Regional Court in Poznań issued a preliminary injunction on June 16, 2016 preventing Gildia Sp. z o. o. from disseminating:
– information in any form concerning the poor financial standing of SECO/WARWICK Europe Sp. z o. o., i.e. that SECO/WARWICK Europe Sp. z o. o. currently has a poor financial condition, or that may cause a recipient of such information a false understanding about SECO/WARWICK Europe Sp. z o. o.’s actual financial status, including the lack of ability to or the existence of obstacles preventing SECO.WARWICK Europe Sp. z o. o. from fulfilling its obligations;
– information about the financial condition of SECO/WARWICK Group.
The Regional Court in Poznań, in accordance with article 7562 § 1 of the Code of Civil Procedure, ordered Gildia sp. z o. o. to abide by the injunction under the penalty of rewarding SECO/WARWICK Europe Sp. z o .o. the amount of 20.000 PLN (twenty thousand Polish Zloty) for each infringement of the above obligation.
